Please have this reviewed by a licensed attorney before publishing.These Terms of Service ("Terms") govern your use of the CalScore mobile application and calscore.ai website (together, the "Service"), operated by ABIMIK, LLC ("CalScore," "we," "us," or "our").By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.1. EligibilityYou must be at least 16 years old to use CalScore. By using the Service, you represent that you meet this requirement and that all information you provide is accurate.2. Not Medical AdviceCalScore provides nutrition tracking, gamified scoring, and wellness-related estimates for informational and entertainment purposes only. CalScore is not a medical device and does not provide medical, nutritional, or psychological advice, diagnosis, or treatment. Always consult a qualified healthcare professional before making decisions about your diet, weight, fasting practices, or health, especially if you have a pre-existing medical condition, are pregnant, or have a history of disordered eating.Estimates shown in the app — including calorie burn, Metabolic Trend Estimate, and QualityScore — are approximations based on the information you provide and general models, and may not reflect your actual physiology.3. Your AccountYou are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at [email protected] if you suspect unauthorized use of your account.4. Subscriptions and Payment• CalScore offers free and paid subscription tiers ("Paid" and "Premium"), as described in the app.
• Paid subscriptions are billed in advance on a recurring basis (monthly or annually) through Apple, Google, or our payment processor, until cancelled.
• You may cancel your subscription at any time through your Apple ID, Google Play, or account settings. Cancellation takes effect at the end of the current billing period; we do not provide refunds for partial billing periods except where required by law.
• Prices are subject to change with notice as required by applicable law and app store policies.5. Coach Dashboard and Data SharingIf you connect your account to a coach or trainer through the Coach Dashboard feature, you authorize CalScore to share your logged data, scores, and progress with that coach for as long as the connection is active. You may disconnect a coach at any time in Settings, which will stop future data sharing.6. Acceptable UseYou agree not to:
• Use the Service for any unlawful purpose
• Attempt to reverse-engineer, decompile, or interfere with the Service
• Upload content that is unlawful, infringing, or harmful
• Use the Service to harass, impersonate, or harm another user, including through leaderboard or social features
• Circumvent or manipulate scoring mechanisms in bad faithWe reserve the right to suspend or terminate accounts that violate these Terms.7. User ContentYou retain ownership of the photos and content you upload (e.g., meal photos). By uploading content, you grant CalScore a limited license to use, store, and process that content solely to provide and improve the Service, including sending photos to third-party food-recognition providers for analysis.8. Third-Party ServicesThe Service integrates with third-party providers (e.g., Apple Health, TastyAPI, Chomp API, RevenueCat) to deliver certain features. We are not responsible for the accuracy, availability, or practices of these third-party services, which are governed by their own terms.9. DisclaimersTHE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY SCORES OR ESTIMATES WILL BE ACCURATE.10. Limitation of LiabilityTO THE MAXIMUM EXTENT PERMITTED BY LAW, CALSCORE AND ABIMIK, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, HEALTH OUTCOMES, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.11. TerminationYou may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or for any other reason, with or without notice, to the extent permitted by law.12. Changes to the Service or TermsWe may modify the Service or these Terms at any time. We will notify you of material changes to these Terms by posting an updated version with a new "Last updated" date, and, where required by law, through additional notice. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.13. Governing LawThese Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law principles, unless otherwise required by applicable consumer protection law in your jurisdiction.14.
